Examples of such unpaid overtime claims include:
- Being required to only clock your scheduled 37.5 or 40 hours per week, despite working before and after your shifts and during unpaid meal breaks.
- Handling communications such as calls, texts, emails, or group messages with other employees or supervisors while off-the-clock and/or on your “days off.”
- Working pre-shift or post-shift off-the-clock due to labor budget restrictions or other company demands, and not being able to claim all hours worked absent “pre-approval,” even though such “pre-approval” is rarely given despite beg required to work over 40 hours per week to timely complete your job duties.
Currently pending before the Court is Plaintiffs’ Motion to Facilitate Notice Under 29 U.S.C. Section 216(b). This Motion asks the Court to permit the matter to proceed as a conditionally certified collective action (which is similar to a class action). If the Motion is granted, the Court would authorize notice of the lawsuit to be issued to Client Service Associates and Client Associates nationwide, giving those who experienced similar unpaid wage issues an opportunity to join the case and assert their own claims as to alleged unpaid wages. While the Motion for Conditional Certification is pending, any current or former Gallagher Client Service Associates and Client Associates who worked unpaid overtime hours at any time at least as far back as February 28, 2021, can join the case.
